By accessing or using AskAlong ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and AskAlong ("we," "us," or "our"). We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service after modifications constitutes your acceptance of the updated Terms.

2. Description of Service

AskAlong is a mobile application that provides AI-powered question and answer functionality for podcast content. The Service allows you to:

• Listen to podcast episodes
• Ask questions about podcast content using voice or text
• Receive AI-generated answers based on podcast context
• Create and manage playlists
• Access premium features through subscriptions

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

3.1 Account Creation

You may create an account to access certain features of the Service. You must provide accurate, current, and complete information during registration and keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

You may terminate your account at any time through the Service settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

5. Subscriptions and Payments

The Service offers premium features through paid subscriptions. Subscription fees are billed in advance on a recurring basis (monthly or annually) unless cancelled.

5.2 Payment Processing

Payments are processed through third-party payment processors (e.g., Apple App Store, Google Play Store, RevenueCat). You agree to provide accurate payment information and authorize us to charge your payment method for all fees incurred.

5.3 Subscription Renewal

Subscriptions automatically renew unless you cancel before the end of the current billing period. You can cancel your subscription at any time through your device settings or the Service's subscription management interface.

5.4 Refunds

Refund policies are governed by the terms of the platform through which you purchased the subscription (Apple App Store or Google Play Store). We do not provide direct refunds, but you may request refunds through the respective platform's refund policies.

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of providing and improving the Service.

6.3 Third-Party Content

Podcast content available through the Service is owned by third parties. We do not claim ownership of such content. You are responsible for ensuring your use of third-party content complies with applicable laws and the rights of content owners.

7. AI-Generated Content

The Service uses artificial intelligence to generate answers to your questions. You acknowledge and agree that:

• AI-generated answers may contain errors or inaccuracies
• AI-generated content should not be considered as professional, legal, medical, or financial advice
• You should verify important information independently
• We are not responsible for any consequences resulting from reliance on AI-generated content
• AI-generated content is based on available information and may not reflect the most current information

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Defects will be corrected
• The Service or servers are free of viruses or other harmful components
• AI-generated answers are accurate, complete, or suitable for any purpose

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

You agree to indemnify, defend, and hold harmless AskAlong and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You will not be entitled to any refunds for unused subscription periods
• All provisions of these Terms that by their nature should survive termination will survive

13. Dispute Resolution

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.
